1. Introduction
Welcome to GardenAtlasOrbit ("we," "us," or "our"). These Terms and Conditions ("Terms") apply to your use of our yacht charter services and the website at gardenatlasorbit.site (the "Service") operated by GardenAtlasOrbit.
By using the Service or reserving a charter, you agree to these Terms. If you do not agree with any part of the Terms, you must not use the Service.
2. Service Overview
GardenAtlasOrbit offers high-end yacht charter experiences, including but not limited to:
- Single-day yacht hires
- Evening sunset sailings
- Company retreats
- Exclusive private functions
- Charters spanning multiple days
All offerings depend on availability and prevailing weather. We may modify or discontinue services at any time.
3. Booking and Reservations
3.1 How to Book
To secure a charter, you must:
- Be 18 years of age or older
- Supply accurate and complete details
- Pay the deposit specified in your booking confirmation
- Accept these Terms and Conditions
3.2 Confirmation
A reservation is confirmed only after we receive payment and issue written confirmation. We reserve the right to refuse service at our discretion.
3.3 Availability
Every charter depends on vessel availability and safe weather conditions. We will make reasonable efforts to honor your preferred dates and times.
4. Payment Terms
4.1 Pricing
All rates are in € and include applicable taxes unless otherwise noted. Prices may change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter price due at the time of booking
- Balance: Payable 48 hours before departure
- Additional charges (if applicable): Due at the end of the charter
4.3 Payment Methods
We accept major credit cards, bank transfers, and certified checks. Payments are processed through secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full refund less processing fees
- 24–72 hours before departure: 50% refund
- Under 24 hours before departure: No refund
5.2 Weather Cancellations
If our captain determines conditions are unsafe, we will:
- Reschedule your charter to the next available date at no extra charge
- Issue a full refund if rescheduling cannot be arranged
5.3 Mechanical Issues
If the assigned vessel experiences mechanical issues, we will attempt to provide a suitable alternative. If no alternative is available, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Follow all crew directions
- Use the provided safety gear when required
- Disclose any medical conditions that may affect their safety
- Stay within designated areas of the vessel
6.2 Prohibited Items
The following are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive non-alcoholic drinks (such as juice or lemonade), beyond reasonable consumption
- Pets (unless pre-approved)
6.3 Conduct
Guests are expected to behave respectfully. We reserve the right to end a charter early without refund if behavior presents a safety risk or disrupts others.
7. Liability and Insurance
7.1 Our Liability
Our liability is limited to the amount you paid for your charter. We are not liable for:
- Injuries arising from passenger negligence
- Loss of or damage to personal belongings
- Indirect, consequential, or punitive damages
- Delays due to weather or factors beyond our control
7.2 Insurance Coverage
We carry comprehensive marine insurance for our vessels and operations. Passengers are responsible for their own travel and personal insurance.
7.3 Assumption of Risk
By taking part in our charters, you acknowledge that marine activities carry inherent risks and accept responsibility for your own safety and well-being.
8. Modifications and Itinerary Changes
We may adjust itineraries, routes, or schedules due to weather, safety, or operational needs. Every effort will be made to provide comparable alternative experiences.
9. Force Majeure
We are not responsible for delays, cancellations, or changes resulting from events beyond our control, including but not limited to:
- Severe weather
- Natural disasters
- Government actions or regulations
- Port closures
- Mechanical failures
10. Privacy and Data Protection
We handle your personal data in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
11. Intellectual Property
All content on our site, including text, graphics, logos, and images, is protected by copyright and trademark laws. You may not copy, distribute, or create derivative works without our written consent.
12. Governing Law
These Terms are governed by the laws of Monaco. Any disputes will be resolved in the courts located in Monaco, Monaco.
